NHTSA Responds to ABS Inc.'s Freedom of Information Act Request On November 7, 2002, ABS President William Washington requested documents from the National Highway Traffic Safety Administration in accordance with the Freedom of Information Act. Manufacturers Apply for Exemptions to Use Pneumatic ABS System Several truck and trailer manufacturers have applied to the National Highway Traffic Safety Administration for an Exemption to the 49 CFR 571.121 antilock brake system standard for the use of electronic abs systems. The Exemptions are being requested pursuant to 49 U.S.C. 30113(b)(3)(B)(ii). This provision provides for "...the exemption would make easier the development or field evaluation of a new motor vehicle safety feature providing a safety level at least equal to the safety level of the standard." Exemptions are also being requested pursuant to 49 U.S.C. 30113(b)(3)(B)(iv). This provision provides for "...compliance with the standard would prevent the manufacturer from selling a motor vehicle with an overall safety level at least equal to the overall safety level of nonexempt vehicles." OEM's (truck and trailer manufacturers) are eligible for the Exemptions pursuant to 49 U.S.C. 30113(c)(2) & (4).
